Updated 17 October 2026. Colorado’s 2026 changes should not be described as the disappearance of developer accountability. That earlier framing was too broad. The enacted SB26-189 includes technical documentation, records and consumer-facing requirements.

Connect documentation to the deployed system

The Colorado legislature’s enacted summary says covered developers must provide specified technical documentation from 1 January 2027. It also describes notice requirements and meaningful human review after an adverse consequential decision. Applicability and exceptions need assessment against the actual deployment.

The product question is whether the documentation describes the current system. A limitation recorded for one version may not describe a later configuration. A material update should prompt the team to examine what information downstream users need.

Consider an illustrative decision-support workflow. The deployer needs to understand what the system is intended to do, where it is limited and how a person can review a result. A vendor document that answers none of those questions may be polished without being useful.

Keep the distinction between legal interpretation and implementation visible. A lawyer can help assess the obligation. Product and engineering still need to explain the behaviour and provide reliable evidence. Neither task becomes unnecessary because the other team has completed its document.

The practical next step

Review one real workflow against the relevant documentation. Note mismatches, assign owners and correct them. That is more useful than arguing from a broad label such as “strict” or “soft”.

Keep the resulting decision, its owner and unresolved questions in a short decision record. For claims about agent behaviour, connect the decision to evaluation evidence rather than relying on a successful demonstration alone.
